Terms of Use
The rules for using Mochi, including accounts, creative content, AI providers, credits, acceptable use, availability, and service limitations.
1. Agreement to these terms
These Terms of Use govern your access to and use of the Mochi website, creative workspace, generation tools, models, assets, account features, and related services.
By accessing or using Mochi, you agree to these Terms and the Privacy Policy. If you do not agree, you should not use the service.
2. The Mochi service
Mochi provides an account-based creative workspace for supported AI image generation, video workflows, effects, editing tools, saved assets, history, and related features.
Features, models, providers, limits, output formats, and availability can change over time. A model or feature appearing on a public page does not necessarily mean that it is currently available for generation inside the product.
3. Accounts and account security
You are responsible for maintaining control of your account and authentication methods and for activity performed through your account.
You must provide accurate information where Mochi requires it for account or service operation. You may not use another person's account without permission, attempt to gain unauthorized access, or bypass account, credit, security, provider, or administrative controls.
4. Acceptable use
You may not use Mochi to violate applicable law, infringe intellectual property or privacy rights, distribute malicious code, interfere with the service, abuse infrastructure, circumvent technical restrictions, or attempt to access data that does not belong to you.
You are responsible for how you use prompts, uploads, generated content, and any material you create or distribute through Mochi. Do not use the service to create or distribute content where doing so would violate applicable law or the rights of another person.
Mochi may restrict or suspend access where reasonably necessary to protect users, providers, infrastructure, legal compliance, or the integrity of the service.
5. Your inputs and generated outputs
You are responsible for prompts, uploaded images, video, audio, reference material, and other content you submit to Mochi. You should only submit content that you have the rights and permissions to use.
AI-generated outputs can be unpredictable, inaccurate, incomplete, similar to content generated for other users, or unsuitable for a particular purpose. You are responsible for reviewing outputs before relying on, publishing, selling, or otherwise using them.
Any rights you may have in generated outputs can depend on applicable law, the model provider used, the source material you supplied, and other relevant terms. Mochi does not promise that every output is eligible for copyright, exclusive ownership, trademark protection, or commercial use.
6. Mochi platform and intellectual property
Mochi and its licensors retain their rights in the website, software, interface, branding, product design, documentation, and other materials that make up the service.
Using Mochi does not give you ownership of the Mochi platform, its software, trademarks, branding, or third-party models and services. You may not copy, reverse engineer, resell, sublicense, or exploit the service itself except where applicable law expressly allows it.
7. AI models and third-party services
Some Mochi workflows rely on third-party AI model providers, hosting providers, authentication services, email services, and other infrastructure.
When a workflow uses an external provider, the information needed to perform that request may be processed by that provider. Provider terms, availability, safety rules, limits, latency, output quality, and pricing can change independently of Mochi.
Mochi may disable, replace, relabel, or limit a workflow when a provider is unavailable, changes its requirements, or cannot be supported reliably or safely.
8. Credits, plans, and billing
Mochi may use credits to measure generation capacity. Credit costs can vary by model, workflow, output settings, or provider requirements.
Paid checkout is not currently active. Starter, Creator, Pro, or other paid plans shown on the Pricing page are previews until Mochi explicitly enables purchasing.
Before paid subscriptions launch, Mochi will publish any additional billing terms needed for pricing, renewals, cancellations, refunds, taxes, plan changes, and expiration or rollover of credits.
9. Availability and changes
Mochi is an evolving service. Features may be added, changed, limited, suspended, or removed to improve quality, respond to provider changes, maintain security, comply with law, or operate the service reliably.
Mochi does not guarantee that every feature, model, output style, provider, generation speed, or service characteristic will remain available or unchanged.
10. Privacy
Mochi processes account information, prompts, uploads, generation data, support information, and related service data as described in the Privacy Policy.
By using Mochi, you acknowledge that information required to provide a requested workflow may be processed by Mochi and relevant service or model providers.
11. Suspension and account closure
You may use available account controls to manage or request deletion of your account where those controls are supported.
Mochi may restrict, suspend, or terminate access where reasonably necessary to enforce these Terms, respond to security or abuse concerns, protect other users or providers, comply with law, or prevent material harm to the service.
Sections that by their nature should continue after account closure, including provisions concerning responsibility for content, intellectual property, disclaimers, and legal obligations, may continue to apply.
12. AI and service disclaimers
Mochi and AI-generated content are provided on an as-available basis. AI systems can produce unexpected, inaccurate, offensive, incomplete, or unusable results, and the same or similar outputs may be produced for more than one user.
Mochi does not guarantee uninterrupted availability, error-free operation, a particular generation result, fitness for a specific purpose, or that an output will not implicate third-party rights.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under applicable consumer law.
13. Responsibility and liability
You are responsible for deciding whether a generated output is appropriate for your intended use and for complying with applicable law, licenses, permissions, and third-party rights.
To the extent permitted by applicable law, Mochi is not responsible for indirect, incidental, special, consequential, or similar losses arising from reliance on generated content, third-party providers, interrupted access, or changes to the service.
These Terms do not limit liability or consumer protections where applicable law does not allow such a limitation.
14. Applicable rights and jurisdiction
These Terms do not override consumer protections or other mandatory rights that apply to you.
Mochi is currently operating under the Mochi service identity. Any legal-entity, governing-law, dispute-resolution, or venue details required for paid services or a particular operating structure will be published before those terms become applicable.
15. Changes to these terms
Mochi may update these Terms as the product, providers, legal requirements, or business model changes. When a material update is made, the effective date shown at the top of this page will be revised.
Your continued use of Mochi after updated Terms take effect means the updated Terms apply to your continued use to the extent permitted by applicable law.
